In November, CIA employee Asif Rahman was charged with violating the Espionage Act. The US government alleged that he disclosed two documents revealing American military assessments of Israel’s plan to strike Iran. Rahman has pleaded not guilty.

The US government has argued that Rahman should be held in pretrial detention, in part because his knowledge of classified information makes him an ongoing danger to national security. In legal whiplash, a magistrate judge rebuked the government and ordered him released, only for a District Judge to reverse the decision. Policy Director Chip Gibbons was in the court for both hearings. He reported on them for The Dissenter, a newsletter focusing on press freedom and whistleblower issues. The detention issue is now before the Fourth Circuit Court of Appeals. The defense has refused to waive their speedy trial rights, demanding a February trial date.
